Article 1 – Scope

The following terms and conditions control the offering and selling of products at Cobanaclub.com

Items purchased on this website are qualified directly by Cobanaclub.com

Customers must ensure that they read the information concerning rules of the Legislative Decree 196/2003 ‘’ THE PROTECTION OF PERSONAL INFORMATION CODE”, and in turn agree to the processing of personal data before proceeding with any purchases.

 

Article 2 – General conditions of sale acceptance

Customers should review general conditions of sale and privacy policies on the given website before making any purchases. If a customer proceeds with a purchase, it is assumed that they have indeed given full acknowledgement and agreement to such policies, and without such acceptance, purchases should not be made.

Through purchasing a product or products, customers are accepting the general terms and conditions of the sale, including the payment, as well as reading in full the privacy policy. The customer will have given clear consent for the processing of personal information and agrees to comply with any stipulated agreements, including the payment method.

Products offered on Cobana Clubs website are done so exclusively by Cobana Club to persons of or over the age of 18, and who are legally competent.

 

Article 3 – How to purchase

Any purchase of products completed by customers is done so in coordination with what is displayed and described on the website, including the indicated price and additional taxes and fees, which may vary depending on location. Additional costs include the cost of shipping, all of which will be shown at the moment of purchase.

The number of units available will determine the availability of items, and Cobana Club cannot guarantee the delivery of products ordered. Cobana Club will provide customers with the option of reserving products where possible and will communicate fully concerning delivery time (may sometimes take longer than usual) with the customer either by email.

Before completing any purchase, the customer will always be made aware of the specific unit cost of each product selected, as well as the total number ordered (if more than one) and any delivery charge.

Having completed their purchase, customers will receive an email confirmation of their order, with Cobana Club stating that it has been received, as well as providing a unique order number. After this, customers will receive a second email, this time confirming the acceptance of any such order, including the delivery of products to the stated address and estimated delivery date. This information provides clients with the opportunity to check relevant information, and if the necessary report and/or request further information at [email protected]

 

Customers will be able to check the status of the order in the customer area.

 

Orders will have one of the following statuses:

 

PROCESSING: Order has been made by the Customer and their payment has been verified. Orders will be automatically canceled by the international banking system should no authorization be received.

 

ON HOLD: Cobana Clubhas received the order, but waiting for payment confirmation from the customer.

 

COMPLETED: Purchased goods have been delivered to the relevant courier for transportation.

 

Article 4 – Methods of Payment

Payment by installments is allowed by Cobana Club partners

Should the customer choose to pay with one of the credit card options otherwise accepted and displayed on the website, any payment must be made with the submission of the purchase order. The validity of such a payment method will be stringently checked by the provider during the order process, with an email being sent to the customer indicating the results. Credit is received by Cobana Club at the moment of the shipment of products.

Product prices are subject to change, however, confirmed orders may or may not be affected by any such alterations.

Should the provider or institution issuing the credit card refuse payment for any reason, Cobana Club will not be held responsible for any delay or non-delivery of items.

Cobana Club reserves the right to automatically cancel any order in the absence of relevant information needed to complete a transaction.

Information from the buyer’s credit card or financial information will at no time be known by Cobana Club. Such information is transmitted through a secure and safe connection to an online portal for the bank or finance company provided by the customer. Therefore, Cobana Club will not be held responsible for any fraudulent or illegal use of credit cards which may potentially occur during the transaction of a purchase. Should use as a method of payment offered by Cobana Club, customers will be directed immediately to the page in order to complete their order. In the case of a cancellation by the customer or non-acceptance by Cobana Club, the amount will be refunded to the Customer’s individual Bank account. Cobana Club will in no event be liable for any damages, direct or indirect, as a result of any delays in releasing the amount committed by such payment processes . For each transaction made with the Cobana Club account, the customer will receive (by email) confirmation from Cobana Club. Cobana Club reserves the right to cancel and/or suspend the order if sends an e-mail message showing errors and/or irregularities in the payment. In such an instance, Cobana Club reserves the right to attain additional information from the customer, as well as the sending of documents to prove the ownership of credit cards. Cobana Club also reserves the right not to accept the order without any right for the Customer to claim damages.

Should the customer cancel an order reserved with payment by credit card, bank transfer, Cobana Club will reimbursement through the same chosen method of payment made by the Customer, with requests for other methodologies not being permitted under any circumstances.

Customer data is processed in a manner that prevents third parties from coming into contact with them. Until the time in which customers confirm any order, the data surrounding credit card details will reside exclusively on the customer’s computer or device.

 

Article 5 – Delivery

Cobana Club can deliver worldwide. Our freight partners are UPS, DHL, FedEx and Postal service. The average delivery time within Europe is 3-5 business days. For shipping destinations outside Europe, such as North America and Asia, the delivery time is 5-10 business days, however, delivery times may increase depending on the delivery destination and delivery times could also change during the covid19 crisis.

Invoices for orders delivered by couriers are available to both download and print online from the customer’s individual account area. Once such information has been issued, no changes can be generated.

All our vendors offer a worldwide shipping fee starting from 15€/17$ for each individual warehouse order, no matter the dimensions or weight of the package. For stocklot orders that might include an additional discount, a member of our customer services team will contact the customer to discuss shipment details and delivery time.

Lost or damaged packages are insured a maximum amount of 30€ unless agreed upon differently from the buyer and added as a note when making a purchase. Extra insurance can be purchased, by contacting our team at [email protected]

Products are dispatched from Cobana Club partners or warehouses within 1-3 business days after the order has been payment has been confirmed, and are always subject to checking the regularity of the payment before carrying it out. In the case of orders with payments in advance other than bank transfer and where Cobana Club has report of anomalies, such as the mismatch of the name of the person registered and the holder of the credit card, the goods are delivered within 7 working days from when it has been checked for regularity of the payment, or at least from the end of the tests that will be necessary to verify the regularity of payment. In the unlikely event that a product has not been delivered after 10 working days following the order confirmation, customers should send a direct email to [email protected] with the subject line “non-delivery”, while also stating the order number as well as any other additional information. Having received the email, Cobana Club will contact the customer within 2 working days in order to resolve the problem, or in some cases offer an explanation for the non-fulfillment of orders. For an unclaimed package that is returned to the vendor, the buyer will need to cover a fixed fee of 45€/55$, which will be invoiced for or deducted from the refund

Returns due to wrong shipping information provided such as name or address will be covered by the buyer with a fixed fee of 45€/55$.

Customs operations are handled by Cobana Club and Partnerships together with the selected freight provider customs agency for shipments outside the EU all additional customs charges will be covered by the buyer. Any documentation needed will be provided by Cobana Club to have the package cleared if necessary. Article 6a – Refunds and Returns

Cobana Club: We offer a 14-day return policy to partners. from the day the package is delivered to your customer. Returns that are shipped back after the 14-day policy will be rejected and shipped back to the original dispatch address.

For defects and wrong shipped items, the customer must contact Cobana Club [email protected] within 14 days. Such emails should include the date of purchase and photographic evidence. In any such cases, Cobana Club will provide a return label to you to have the defective/wrong item is shipped back to us.

The cost of return shipment will be borne by the customer and should always be shipped back with an active tracking number. All returns need to be shipped back with UPS, DHL or FedEx. Due to long delivery time we do not accept any local Postal Service.
Any returns that are due with customs charges will be covered by the buyer. Either by invoice or will be deducted from the original refund. To offer faster refund we recommend selecting the option of the sender paying for all customs duties.

All returns must be in the perfect original condition as the original shipment, along with any original attachments such as tags, box, or dustbag. We have the right to refuse returns if the products have been worn or washed and with a used scent. For declined returns, the order will be shipped to the buyer and any additional shipping charges will be invoiced.

Any agreed refunds will be made by bank transfer within 5 business days of received and approved returns.

 

Article 7 – Privacy Policy

Cobana Club will be the “owner” of customer’s data and all the information concerning the use of their personal data is summarised in the privacy document, in accordance with the Protection of Personal Information legislation. Customers must, therefore, accept such a policy before proceeding with any purchases, with a particular focus on the following areas:

  • Purposes of data processing. Commercial, promotional, and/or sales purposes to identify potential customers for each specific product or service (eg, statistics, customer satisfaction feedback, the preliminary gathering of information aimed at reaching an agreement or provision of a service, etc.); Customer satisfaction research (eg research on the quality of services); Fulfillment of obligations under the law, regulations or legislation.
  • Data communication. The personal data collected by Cobana Club will be communicated and/or processed by people we trust, who, in pursuit of the above objectives, carry out operational, technical, and organizational tasks. The personal data provided by Customers are used only to perform the job or related services; the data are not disclosed to third parties unless such disclosure is required by law or is directly necessary for the fulfillment of requirements.

All the details of the credit cards processed by email/ telephone/ fax are processed by secure server and immediately canceled after the transaction.

Rights of interested parties. – It is fully established that the customer has the option to exercise specific rights. The Customer may obtain: confirmation or otherwise of the existence of data concerning them, even if not yet recorded;

Information about the origin of personal data, the purpose and methods of processing it, and the basis of processing in cases where this is done using electronic instruments;

Indication of the identity of the Owner and the Person Responsible, and the persons or categories of persons to whom the personal data may be communicated or who have access to them;

The cancellation, transformation into anonymous form or blocking of data processed in violation of the law, as well as updating, rectification or, where interested, integration of data unless it is impossible or involves the use of disproportionate means. The Customer may also object, for legitimate reasons, to the processing of personal data about them, even if it relates to the purpose of the data collection. The Customer can also object to the processing of personal data for sending advertising material or otherwise, aimed at carrying out market research and business communications.

Buyers:

All sales on lingerie and swimwear are generally final for reasons of hygiene.

Returns of any type of merchandise will not be accepted without prior Authorization. Any unauthorized returns will be refused.

All claims for damaged or incorrect goods, or a discrepancy in quantities shipped must be reported within five business days after receipt of goods. We will not accept returns for any merchandise either worn, damaged in-store and not in their original packaging. Evidence of damage must be submitted with report. Approved returns will be repaired or replaced as appropriate.

Should a style had been out of stock on certain sizes we will not accept requests later to return the remaining sizes for this reason.

We will not physically accept returns at this time. Please do not ship to us.

All sales are final for goods on closeout (sale).
